1. Overview

Welcome to Jowitt (“we”, “us”, “our”). We operate this website and online store (the “Services”) to offer our products for purchase. By accessing or using the Services, you agree to these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, please do not use the Services.

2. Access & Accounts

You must be 18+ to purchase. You may be asked to provide information (e.g., email, billing, shipping, payment). You warrant this information is accurate and you have the right to provide it. You’re responsible for safeguarding any account credentials and all activity under your account.

3. Our Products

We make every effort to describe and display products accurately, but colours and finishes can vary by device settings. Natural variations in leather are part of each piece’s character and are not faults. We may update descriptions, discontinue items, or limit quantities at our discretion.

4. Orders

Placing an order is an offer to buy. We may accept or decline any order. An order is accepted once payment is processed and we send confirmation. Please review your order carefully—cancellations may not be possible after acceptance. Your purchases are subject to our Refunds & Returns Policy.

You confirm your purchases are for personal/household use and not for resale.

5. Prices, Taxes & Billing

Prices, promotions and shipping rates may change without notice. The price charged will be the price at checkout. Unless stated otherwise, prices exclude shipping and any applicable taxes/duties.

You agree to provide current, complete billing details and authorise us (or our payment processor) to charge your selected payment method for the total order amount.

6. Shipping & Delivery

Dispatch timeframes are shown at checkout or in our Shipping Policy. Delivery times are estimates and not guaranteed. Title and risk in goods pass to you when we hand the order to the carrier. We are not responsible for delays caused by carriers, customs, or events beyond our control, but we’ll assist where we can.

7. Australian Consumer Law (ACL)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits your rights under the ACL.

8. Intellectual Property

All content on the Services (including trademarks, logos, text, images and layout) is owned by Jowitt Pty Ltd or our licensors. You may use the Services for personal, non-commercial purposes only. No licence to our IP is granted except as needed to use the Services. Jowitt names and logos are our trademarks. Other trademarks belong to their respective owners.

9. Third-Party Tools & Links

We may provide access to third-party tools or link to third-party sites. These are provided “as is” and “as available” and are used at your own risk. We are not responsible for third-party content, policies, products or services.

10. Powered by Shopify

Our store is hosted on Shopify, which provides the e-commerce platform. Sales are made directly between you and Jowitt Pty Ltd. Shopify is not a party to your transactions with us.

11. Privacy

We handle personal information in line with our Privacy Policy. Because our store is hosted by Shopify, some data is processed by Shopify and its service providers (which may be located outside Australia). Please review both policies for details.

12. Feedback & Reviews

If you provide feedback, ideas, or reviews (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use and display the Feedback for any purpose. You warrant you own or control the rights to your Feedback and it complies with applicable laws and these Terms. We may remove Feedback at our discretion.

13. Errors & Changes

From time to time, information on the Services may contain typographical errors or omissions (e.g., pricing, availability). We may correct or update information or cancel orders if information is inaccurate, including after an order is submitted.

14. Prohibited Uses

You must not misuse the Services, including by: violating laws; infringing IP rights; harassing or harming others; transmitting malware or spam; scraping or crawling; or attempting to bypass security. We may suspend or terminate access for violations.

15. Termination

We may suspend or terminate the Services (or your access) at any time. You remain responsible for all amounts due up to the date of termination. Sections intended to survive termination will continue to apply.

16. Warranties & Disclaimers

Except as required by law (including the ACL) and to the extent permitted, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free operation of the Services.

17. Limitation of Liability

To the fullest extent permitted by law and subject to the ACL, we exclude all liability for indirect or consequential loss, loss of profits, revenue, data or goodwill, and limit our aggregate liability arising in connection with the Services or products to the amount you paid for the relevant product(s).

18. Indemnity

You agree to indemnify and hold harmless Jowitt Pty Ltd and our officers, employees and agents from claims and losses arising from your breach of these Terms or misuse of the Services.

19. Severability

If any provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remainder will continue in full force.

20. No Waiver; Entire Agreement

A failure to exercise a right is not a waiver. These Terms and the policies referenced herein constitute the entire agreement between you and us regarding the Services.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our consent. We may assign or transfer our rights and obligations without notice.

22. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

We may update these Terms from time to time. Material changes will be notified in accordance with applicable law. Your continued use of the Services after changes take effect constitutes acceptance.
